2. Scope

These terms and conditions apply to all contracts between Starphone and customers. especially for:

– Online orders via www.starphone.de
– Purchases in the physical store
– Repair and service work

They apply to consumers (§ 13 BGB) and entrepreneurs (§ 14 BGB). Deviating terms and conditions do not apply unless expressly agreed to in writing.

3. Conclusion of contract

The presentation of products in the online shop does not constitute a binding offer. By completing the order, the customer submits a binding offer. The contract is concluded upon order confirmation or shipment of the goods.

4. Prices and Payment Terms

All prices are in euros. Unless otherwise stated, They include the statutory value added tax.

For used goods, taxation can be carried out according to § 25a UStG. (Differential taxation) will be applied. In this case, the value added tax will be... not shown separately.

Payment is made via the payment methods offered in the online shop. especially PayPal or Shopify Payments.

The purchase price is due immediately upon conclusion of the contract.

5. Retention of title

The goods remain the property of Starphone until full payment is received. This applies to entrepreneurs until full payment is received. all claims arising from the business relationship.

6. Delivery and Shipping

Delivery will be made to the address provided by the customer.

The delivery area includes the European Union (EU) as well as selected third countries, provided these can be selected during the ordering process.

6.1 Delivery times

Delivery within Germany usually takes 2–6 working days. Within the EU, 3-8 working days, unless otherwise stated.

6.2 Deliveries to third countries (outside the EU)

For deliveries to countries outside the European Union Shipping according to Incoterm DAP (Delivered At Place) .

Import duties, customs duties, import sales tax and other country-specific charges Fees are to be borne by the recipient.

Starphone accepts no liability for the amount or calculation such levies.

Delays due to customs inspections are beyond our control.

If the buyer refuses to accept the shipment due to import duties, or if he does not collect them on time, we reserve the right to... to deduct the return shipping costs we incurred from the refund amount.

7. Transfer of Risk

For consumers, the risk passes to them upon delivery of the goods. For entrepreneurs, the risk passes to them upon handover to the shipping company.

8. Right of withdrawal (online shop)

There is no right of withdrawal for purchases made in physical stores. Entrepreneurs are not entitled to a right of withdrawal.

9. Warranty

The statutory warranty rights apply.

No warranty is provided in case of improper use. Moisture damage, external interference or wear and tear.

10. Repair and service work

10.1 Device status

Devices may have prior damage or undetectable defects. These may only become apparent during the repair process.

10.2 Repair risks

During repairs – especially structural interventions – Despite proper execution, further damage can occur. This includes loss of function or limitations. This does not constitute a defect in the repair service.

10.3 Data

The customer is responsible for backing up their own data. Liability for data loss is excluded. to the extent permitted by law.

11. Liability

Starphone is liable without limitation in cases of intent or gross negligence. and in cases of injury to life, body or health.

In cases of slight negligence, Starphone is only liable for injury. essential contractual obligations and limited to the typical, foreseeable damage under the contract.

12. Jurisdiction and applicable law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

The place of jurisdiction for entrepreneurs is the registered office of Starphone. For consumers, the statutory places of jurisdiction apply.

13. Severability Clause

Should any provision of these terms and conditions be invalid, The effectiveness of the remaining provisions remains unaffected.
